Which personal data do we process for which purpose?
Registration
If you register an account with Beams we use the data provided by you for setting up the account, for your access to it, to manage the account, and for your usage of the features of Beans as technically required. The legal basis for this processing is Art. 6 Para. 1 b) GDPR.
User Content
All personal data you include in User Content, as defined in the Terms of Service, is used for using and publishing it as described in the Terms of Service. In a nutshell: Your User Content will be published on the web and in our Apps. Everybody can watch and download it and receives the rights on it as agreed in the Terms of Service.The legal basis for this processing is Art. 6 Para. 1 b) GDPR.
TrueDepth camera
For some features that you might have access to, we are utilizing iPhone’s TrueDepth camera feature. This feature allows us to detect your facial expressions and positioning in 3D space. We only use this information to display a 3D model of your face on the screen while you are recording your audio content. If you choose to publish such recording, the data collected like this will be sent to and stored on our servers and will be available for everyone to watch and download in the same way as the rest of the User Content. You are in control of this data and can choose to delete it at any time.
GPS position of photos
Photos you upload might include information where the photo has been taken. We save this information with your photo and use it to suggest to you places nearby so that you can tag your photos accordingly. If you allow access to the GPS data of the device you use we only use it to fetch you position if you make a photo with our app to use this information as described before. You can revoke the access to the GPS data on your device anytime using its system settings and you can remove the gps meta data of picture in your photo library. It is not mandatory to upload photos with gps data attached. You can delete any of your User Content any time. Legal basis for the processing of the GPS data is Art. 6 Para. 1 b) GDPR as this is part of the functionality of Beams. No third processor has access to the GPS information.

Google Maps
To enable our users to attach User Content to places we use Google Maps a service run by Google Ireland Limited (“Google”), a company incorporated and organised under Irish law (registration number: 368047) with registered office at Gordon House, Barrow Street, Dublin 4, Ireland; https://www.google.de/contact/impressum.html, if you are in the European Economic Area or Switzerland. When your device calls up the map, the public IP address of the device you are using is transmitted to Google. The IP address is a unique numerical address under which your device sends or retrieves data in the Internet.
Google Maps is governed by Google’s privacy policy, which is available at https://www.google.com/policies/privacy/. Our legitimate interest in the use of Google Maps by our users is to help them associate photos with a specific location. The legal basis of the processing is Art. 6 Para. 1 f) GDPR.
Google Analytics
We do use Google Analytics under a data processing agreement to evaluate how our website is found and how our website and apps are being used. We use this data to get information to optimize our website and apps. For the collection of this information the IP-address of your device is used in an anonymized form. The IP address is a unique numerical address under which your device sends or retrieves data in the Internet. Data of Customers who access Beams will only be used for Google Analytics with the prior consent of the user, which can be revoked anytime with effect for the future. The legal basis of the processing is Art. 6 Para. 1 a) GDPR.

Google Firebase
For our apps we do use Google Firebase under a data processing agreement to evaluate how the apps are being used and to find any bugs or performance problems. We use this data to get information to optimize our apps. Google Firebase is run by Google Ireland Limited (“Google”), a company incorporated and organised under Irish law (registration number: 368047) with registered office at Gordon House, Barrow Street, Dublin 4, Ireland; https://www.google.de/contact/impressum.html, if you are in the European Economic Area or Switzerland. To deactivate Google Firebase in our App please use the device settings for the Beams app. The legal basis of the processing is Art. 6 Para. 1 f) GDPR. With this processing, we pursue the legitimate interest to be able to improve our apps.
Newsletter
When you subscribe to our email newsletter, we process the data you provide for the creation and dispatch of the newsletter and for proof of registration. Legal basis of the processing is, based on your consent, Art. 6 para. 1 a) DSGVO.
To confirm your registration for the newsletter, you must click on the confirmation link in the verification email that we send you after your registration. When you click on the link provided in the verification e-mail, we process the date and time of the click, the content of the e-mail sent to you and your e-mail address. The legal basis for this processing is Art. 6 para. 1 c) DSGVO, as we are legally obliged to document and be able to prove the existence of your consent.
Your registration for our newsletter can be revoked at any time with effect for the future.
Your rights
You have, in particular, the following rights in respect to the processing of your personal data. For the details we refer to the legal regulations.
Right of access
According to Art. 15 GDPR, you have the right to ask us for confirmation whether personal data relating to you are being processed. If this is the case, you have a right to information about this personal data and to further information, which is mentioned in Art. 15 GDPR.
Right to rectification
Pursuant to Art. 16 GDPR, you have the right to demand immediate correction of inaccurate personal data concerning you. Furthermore, taking into account the purposes of the processing, you have the right to request the completion of incomplete personal data, including by means of a supplementary statement.
Right to erasure
You have the right to demand that we delete your personal data immediately. We are obliged to delete personal data immediately if the corresponding requirements of Art. 17 GDPR are met. Please refer to Art. 17 GDPR for detail
Right to restriction of processing
In accordance with Art. 18 GDPR, you have the right under certain conditions to demand that we restrict the processing of your personal data.
Right to data portability
Pursuant to Art. 20 GDPR, you have the right to receive the personal data that you have provided us in a structured, common and machine-readable format, and you have the right to transfer this data to another person without hindrance, provided that the processing is based on a consent pursuant to Article 6 (1) (a) GDPR or Article 9 (2) (a) GDPR or a contract pursuant to Article 6 (1) (b) GDPR and the processing is carried out by automated means.
Existence of a right of appeal to the supervisory authority
According to Art. 77 GDPR, without prejudice to any other administrative or judicial remedy, you have the right to complain to the supervisory authority. This right shall apply, in particular, at the Member State of your place of residence, at your place of work or at the place of the alleged infringement, if you consider that the processing of the personal data concerning you is contrary to the GDPR.
Right of objection
Pursuant to Art. 21 GDPR, you have the right to object to the processing of personal data concerning you, which is based on Article 6 (1) (e) or (f) of the GDPR. this also applies to profiling based on these provisions.
